Anti-Spam Policy

Cashmill Bingo is committed to permission-based email marketing practices, and has instituted the following zero-tolerance Anti-Spam Policy. Cashmill Bingo reserves the right to amend this Anti-Spam Policy as it deems necessary, and the amended Anti-Spam Policy will in turn be updated and posted for review.

Cashmill Bingo makes ALL reasonable commercial efforts to conform to the Federal Trade Commission’s CAN-SPAM Act of 2003. Accordingly, Cashmill Bingo expressly prohibits the promotion and marketing of its bingo game through contracted vendors or within its Affiliate Program network by the transmission, distribution or delivery of any unsolicited bulk or unsolicited commercial email (“Spam”).

Under NO circumstances may Cashmill Bingo or its Affiliates deliver Spam or cause Spam to be delivered to any player or prospective player.

In addition, email sent, or caused to be sent, by Cashmill Bingo or its Affiliates may not:
1. Use or contain invalid or forged headers;
2. Use or contain invalid or non-existent domain names;
3. Employ any technique to otherwise misrepresent, hide or obscure any information identifying the point of origin or the transmission path;
4. Use other means of deceptive addressing;
5. Use a third party’s Internet domain name, or be relayed from or through a third party’s equipment, without permission of the third party and Cashmill Bingo;
6. Contain false or misleading information in the subject line or otherwise contain false or misleading content;
7. Fail to comply with additional technical standards described below; and
8. Otherwise violate any provision in the Cashmill Bingo Affiliate Program Terms and Conditions, which are incorporated herein by reference.

Cashmill and its Affiliates must also comply with the following:
1. Emails must be sent from valid email addresses that must be and remain active for a minimum of thirty (30) days from the date the email(s) is sent;
2. The “From” line should be from you and/or your business and not a sales pitch or marketing technique;
3. Emails that are solicitations or advertisements must contain clear and conspicuous identification that the email is a solicitation or advertisement;
4. All Affiliates sending emails must have a physical mailing address supplied in the email;
5. All emails must be for a targeted email list; and
6. All emails must be supplied with a clear and conspicuous opt-out message in the header of the email. All requests to opt-out must be honored within 10 days and the recipient who has opted-out may not be contacted via email again.

Cashmill Bingo does not authorize the harvesting, mining or collection of player email addresses or other player information, as the foregoing constitute Cashmill Bingo’s confidential and proprietary information.

Cashmill Bingo does not permit or authorize any Affiliate to promote and market one or more of its games or promotions within the Affiliate Program in a manner that could damage, disable, overburden or impair Cashmill Bingo directly, any other Cashmill Bingo Affiliate, or that could interfere with any player’s use and enjoyment of the Cashmill’s gaming services.

Each violation of the above provisions is subject to fine up to a maximum of US$10,000. Deceptive commercial email is also subject to laws banning false and misleading advertising. Furthermore, the Department of Justice is allowed to seek criminal penalties, including imprisonment, against senders of commercial emails that fail to adhere to (or conspire to violate) the provisions set forth in this Anti-Spam Policy.

You expressly understand and acknowledge that failure to adhere to this Anti-Spam Policy shall subject you to such actions as Cashmill Bingo, in its sole discretion, deems appropriate including, without limitation: (i) the voiding of any Affiliate earnings to which you may/are otherwise entitled, (ii) the termination of your Affiliate status, (iii) the imposition of fines, and/or (iii) the reimbursements for damages and expenses which Cashmill Bingo or its clients may incur as a result of your conduct.

Cashmill Bingo’s failure to enforce this policy in every instance does not amount to a waiver of Cashmill Bingo's rights hereunder.
